HOW DO WE USE YOUR CONTACT INFORMATION?
We use your contact information for the following purposes only:

IF YOU WISH AND CHOOSE TO REGISTER AT OUR WEBSITE, then our system will automatically register you as a user on our website and keep your full name, address, email and phone number safe and for as long as you wish or until you decide to cancel or delete the registration. This will help you to keep the wishlist, you won't need to enter your delievry address every time you checkout. If you wish us to delete any stored data about you - please email your request to info@fantasmagoria.eu

WHEN YOU PLACE ORDER AT OUR WEBSITE, then then our system will automatically keep your data (full name, address, phone and email) as a customer for until the order is delivered and warranty period passes. You do not have to register as a customer when placing the order at our webshop.

IF YOU SUBSCRIBE TO OUR NEWSLETTER to receive info about new products and promotions.
If for some reason you would prefer not to receive emails from us - you can always unsunscribe by pressing "unsubscribe" button in the end of newsletter email or simply email a request to info@fantasmagoria.eu with the word "UNSUBSCRIBE" in the subject line. Please note that any requests to remove or update your contact information may take seven to ten working days to take effect.

Please note, we never store neither collect any payment information from you. We do not have access nether store neither see our credit card info or your paypal login.

We do not share customer's information with anyone except post or couriers in order for your order to be delivered.

    TERMS OF SERVICE This document contains and explains the terms and conditions under which online shop fantasmagoria.eu ("Fantasmagoria", „Our Company“, "we" or "us") offers you (the „customer“, „buyer“, "user" or "you") access to its website www.fantasmagoria.eu (the "site", „shop“, „store“) and Fantasmagoria Services (purchasing goods). Among other things, these Terms and Conditions describe the user's responsibilities and limits Fantasmagoria's liability. To avoid disappointment, before using any of our Services (placing the order, paying for goods): please read carefully through all the Terms & Conditions and the Site (including help, sizing, product description, and other relevant sections). In the event of conflict between the seller and a buyer these Terms of Service will apply.

    USER ACCEPTANCE By using the Services, provided by Fantasmagoria, you agree to be legally bound and to abide by the following terms and conditions. If you do not agree to these terms and conditions, you must not use our Services. These terms and conditions include FANTASMAGORIA’s privacy policy (the “Privacy Policy”) that is available on the Site.

    LANGUAGE Our terms and conditions, website texts, descriptions, help sections and documents are in English. When buying at our website you agree with our T&C and therefore confirm that you have sufficient English language skills to make the purchase at our web shop and understand these T&C. We do not hold any responsibility for the translations made to any other language with online translator services or any other means. However, if customers have any queries they can contact us by phone or e-mail in English, German, Russian or Lithuanian.

    CHANGES TO TERMS AND CONDITIONS FANTASMAGORIA reserves the right, in its sole discretion, to amend or change these Terms & Conditions at any time upon posting the amended terms on the Site. The amended terms shall automatically be effective. In case we change our T&C – the changes will only be valid for the orders placed after changes were enacted.


    REFUSING TO ACCEPT THE CUSTOMER‘S ORDER. BLOCKED USERS
    We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following:
    * The product ordered being unavailable in stock
    * Our inability to obtain authorization of payment
    * The identification of an error within the product information, including price or promotion
    • In case of an obviously fraudulent order placed
    • In case of „serial refunders“, or in case we think that the buyer is trying to harm our business, or violates the applicable law, we reserve the right to block the user from any future use and orders from our website.


    COPYRIGHT All contents of this website- all the images, text & design are copyrighted, but you are free to use images for our website promotion, post our products on your personal blogs or websites, share items you like on social networks.     We ask for your full name, telephone number, delivery address, email address, payment details to proceed the order. Sometimes we may ask some additional information such as age & interests for competitions, prize draws, or newsletters or personal shopper sign ups. We may obtain information about your usage of our Website to help us develop and improve it further through online surveys and other requests.

    CUSTOMER‘S DATA PROTECTION Your personal data (such as your name, address, phone number, e-mail) will be protected and not visible to anyone except you and www.fantasmagoria.eu shop manager (to manage and proceed your order, to collect bonus points for your purchases). If you have created an account at our website – you will be able to cancel your account at any time (if you have a pending order- account removal will be possible only after your order has been processed, shipped and received by you).
    WE SECURE YOUR PERSONAL DATA We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required to do so by law. We may use your personal information to send you promotional information about third parties which we think you may find interesting, in case you subscribe for it. GOODS RETURNS, REFUNDS, EXCHANGES

RETURNS / REFUNDS

Only returns that meet the requirements listed in Terms & Conditions will be accepted.

Your satisfaction is our top priority. We understand your concerns when shopping online, hence we are as lenient as possible with our return policy, within reason; however, a large amount of responsibility lies with you. Make sure you take a look at our SIZING CHARTS and that you are delighted with your order before checking out. Read the product description, see all related photos, check product colour, on the product picture and in the description, measure your size, and recheck quantity of each item in your cart (basket) to ensure your order is as you want it. And, of course, feel free to contact us with any specific questions you may have about a particular item or size.

 

RETURNING THE PURCHASE

When shipping anything back to us, please follow the instructions on the return label you get with the order. Please return goods within 14 days after receiving the order (starts on delivery day*). 
*The delivery date starts the day when courier claims the package was delivered (based on carrier tracking information and your signature).

To return the order:

1. On the return label or printed invoice (sent with your order), please mark which items you want to return for refund (if any) and which items you wish to return for exchange (if any); write your order number, your full name and contacts.
2. Send the order in the original condition; all goods must be with original labels & packing.
3. Products must be returned to the same address where it was shipped from. Return address: Fantasmagoria, Jaksto 9-106, 01105 Vilnius, Lithuania. Please write our phone number as well: +37060092442
4. Please ensure you adequately package all returns, as we cannot accept liability for damage done to the items returned caused by inadequate packaging. (This includes footwear sent back in unwrapped shoeboxes. Please do not use staples to seal packaging as we cannot be held responsible for damage caused by the customer. Items returned to us are the sender's responsibility, and we cannot be held accountable for post losses. Make sure you send a registered parcel.
5. Please note that the return expenses have to be paid by you (customer).
6. Initial shipment is not refundable, and item exchange delivery expenses must also be paid by customer (unless it's a faulty item or wrong item sent or you are our returning customer). Please note, as it says in our T&C, that in case of return we won’t be able to refund you the shipping costs, and due to high international shipping price we will have to ask you to pay for shipping in case of an exchange.

However, exchange items to our frequent returning customers are sent free of charge.

Some customers prefer to sell the unwanted item on eBay or similar online marketplace and place the new order. In this case, we can give a discount on the exchange item! Please email us for this option.

SPECIAL CONDITIONS FOR OUR CUSTOMERS OUTSIDE EUROPEAN UNION (USA, Canada, Australia, Russia, etc.)
When sending the order back to us, PLEASE MAKE SURE THAT THE VALUE YOU STATE ON THE DECLARATION STICKER (usually blue or green colour) which will be given you at the Post Office) is not more than 10 USD or 10 EUR. And mark the parcel as "gift" or if "gift option is not possible please mark it ad "return for exchange" or "return for refund". Do not insure the parcel, and choose the cheapest shipping possible. Otherwise, the package will end up in customs and the clearance process may take up to 45 days and may include charges up to 30% of the cost stated on the declaration.
The easiest way is to sell the item you do not want to keep through eBay or Facebook Marketplace and order another size or another piece from us ;). Contact us for this option.

RETURNED ITEM CONDITION
ANY RETURNED ITEM MUST BE IN ITS ORIGINAL CONDITION. Do not cut off the label or care instructions that are attached, stick or sewn into the garment before you try the item on and have decided to keep it permanently. Removal of any tags that are sewn into the garment will result in a non-returnable garment. Please be aware that some goods will have to be returned to our Head Office for evaluation and that some of them will have to be examined by the manufacturer before a decision can be made. If we do take your goods in for investigation, we will inform you of the decision as quickly as possible.

Please, be careful when trying on the item. Make sure that the size fits you and you are satisfied with the purchase before removing any tags and throwing away the packages. Please make sure that you try shoes inside the house, and walk some time on a clean surface until you are sure the size fits you well.
PERSONAL HYGIENE. Please do not be offended by the rules, as the following request may seem obvious, but you would be surprised what some customers try to return. When trying out the clothes, please make sure you do not have and will not get into contact with: deodorant, perfume, food, cigarette smoke, filth, dry skin flakes, body grease, animal fur, dust, etc. We do not accept returns of items which have been worn and damaged or soiled. Sorry, but no exceptions.
Our Company does not warranty and is not responsible for damages caused by trying out the received items without care, e.g. trying to put on the clothes which are apparently too small for the customer, using force on fragile items such as jewellery, opening the package without care. We are not liable for defects caused by unusual usage, insufficient or incorrect care. Our Company does not warranty and is not responsible for damages caused by misuse, abuse, accidents, the natural breakdown of materials over time, or problems that may be reasonably expected with regular use, wear and tear or failure to follow bought item care instructions. However, we will provide you with all possible information and advice regarding the repair of the item, spare parts & accessories, care advice.

SPECIAL OFFER FOR RETURNS DURING WINTER HOLIDAYS
During the New Years Holidays period we allow returns to be made after the Holidays. If you are buying someone a gift for Christmas*, and the size does not fit- please email or call us with a request for exchange/return before 5th of January.
*The purchase may be made any time from 1st of November until 31st of December.

NON REFUNDABLE ITEMS
Following EU law and in the interests of hygiene we do not offer refunds and do not accept returns on piercing jewellery & earrings, underwear & swimwear, hosiery such as socks, tights, etc., cosmetic products, lenses, artificial nails & eyelashes. Under EU law, we do not offer refunds and do not accept returns on watches, customised products, made to measure items, CDs &DVDs, magazines, stockings, clothes and accessories made of rubber or PVC. (Unless any of mentioned items are defective).

ITEM EXCHANGE
If you are not satisfied with your purchase and want to exchange it to another size (if available), or another item (if available), please contact us, and follow the standard return rules written in these T&C. Please make sure you read the product description, look at pictures, study our sizing chart and fitting advice, measure yourself before making the order. If you are not sure about your sizing or your body is not standard size- you are welcome to email or call us for advice. You can e-mail us the information about your measurements after placing the order, and we will choose the size that fits you best. We strongly recommend writing your measurements in the comment field on checkout or in the email after/before making your order. Please read our SIZING & MEASUREMENT info page.

RETURN WHEN THERE ARE DEFECTIVE GOODS OR WRONG ITEM
We check all items before shipping, but occasionally (due to human factor) some mistakes (e.g. such as workmanship error) may happen. When there is a defected item sent, or wrong (not as ordered) item shipped, please email us immediately and provide the defect proof – description and photo if possible. To return the purchase- please contact us & follow the rules written on this page.
In case of a defect, which existed before delivery, you have the choice of getting a discount, full or partial refund, a new article or a repaired one. We can refuse your request getting a new article or a repaired one under the restriction of commensurability if, e.g. the costs are not in due proportion to the value of the item. Each case is unique – it will be discussed over the emails or phone conversation with each client individually.

CANCELLING YOUR ORDER
If you decide to cancel your order, please respect our and our employees’ work, and let us know your decision to cancel as soon as possible.
If your order has been shipped already you will have to wait until it arrives, and (without opening it) send it back to us (you will have to pay for the return shipping – all shipping costs and related money transfer charges will have to be covered by customer). We will be able to make a refund once we receive your return, and after we inspect the items returned. The refund may take up to 10 days after we receive your returned purchase. Only the cost of goods will be refunded. Any fees that we get charged for the return of the products by the carrier will be subtracted from your initial payment.
Please note, that you will have to pay all bank (or PayPal) charges, applied to the financial transactions connected with the money refund.
If you wish for the package to be re-sent, you will have to pay the shipping costs, even if you received free shipping initially. For more info, please contact us & follow the rules written in T&C.

MONEY REFUND
REFUND WILL BE ISSUED TO THE SAME ACCOUNT, FROM WHICH THE ORDER WAS PAID. Refund will be done within 2 to 10 days after the return is received at our address. Please note, that, depending on your bank’s policy, a refund may not show up on your account for up to one billing cycle.
 

RETURNING BONUSES AND GIFTS If there are bonus items or free gifts sent with the order – you have to send them back in the original condition. (Bonus items and gifts are provided for successful purchases without the refund). If these items are not sent back – we will have to charge you for these items.
For combination purchases ("buy one, get one free" or "get the lowest priced item free" etc.), you must return any free items or vouchers back to process a refund.
Please note that any warranty does not apply to the items sent as a gift or as a free bonus item. Please note you cannot return the gift or bonus for exchange.

RETURNS DURING HOLIDAYS OR (OUR) VACATIONS Delays on holidays: sometimes during sale periods or other busy periods, all shipping of returns may take longer (Post Offices are very busy, also we may be to busy to go to pick up the returns at the Post Office in time). Please allow several extra working days to 3 weeks for returns deliveries over National Holidays. It may also happen that our customs office inspects your parcel before releasing it for delivery to us. That can cause a few weeks delay (only when the order is shipped outside EU). Busy holiday period starts in the middle of November and ends at the end of January. Also, there might be slight delays during Easter, our Vacation (the dates should be written at the top of the home page of our website) or any other National Holidays or because of extreme weather conditions in some Countries (e.g. heavy snow or storms) 

Please note: We do not accept returns which were sent later than 14 days after you received the order.
We cannot be held responsible if you forgot to send the order back to us, or if you forgot to pick it up from the courier, or if you forgot to open it within 14 days after receiving. We cannot be responsible if your computer had a virus and you couldn't get online to contact us, or you were on vacation, and couldn’t send the package back to us, or you thought you would lose weight that is why you ordered garments 2 sizes smaller and broke it while trying on, so to speak. :)
Changing your mind about the ordered item is your choice, but we are not responsible for shipping costs if you do so.
We will not refund money to another account than the account you used to purchase the goods.

FANTASMAGORIA ONLINE SHOP PRODUCTS INFORMATION

 

COLOUR (COLOR) We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. Please refer to the image and to the product description.

PHOTOS Please note: some photos are made on mannequins whose shapes differ from the human body (such as longer neck to emphasize the necklace, etc.). Clothes may not look (exactly) the same on you as they look on our models.
Sometimes there are additional items in the product photo. Please read the product description to avoid confusion. For example: if you see a photo of trousers with a belt – please refer to the description (There will be a special notice if these trousers are sold with the belt).

PROTECTED IMAGES Please note: you may see our logo or our website address, brand name on most of the images. This is only used to copyright and protect the images. The Copyright logos are only for web display purposes- the logo is not printed on the item itself.

ADDITIONAL IMAGES Sometimes you can see more images of the product, which are different from the first (initial image). These images used to show the customer some possible ways of wearing, fitting, fixing an item, etc. Please refer to the description of a particular product.

PAIR/SINGLE ITEM We always sell and display price for the pair (both items) of boots, shoes, shoelaces, eyelashes, socks. Items such as wristbands, gloves, eye contact lenses, earrings, hairstripes, hair slides, etc can be sold as a pair or as a single item – please refer to the description.

STOCK 98% of all goods displayed online are in stock (except if written otherwise). We keep large quantities of goods in stock to ensure fast shipping and customer satisfaction. Our website accesses our inventory database to determine whether the goods are available. Though we attempt to keep our inventory counts as accurate as possible, there may be errors sometimes which might allow you to purchase items not in stock. This can be caused by a miscount or two orders for the same style/color/size combination being received simultaneously. If the item you ordered is not available for shipping, we will contact you as quickly as possible with information about possible options regarding your order (such as reselecting an item, refunding, shipping an item once it becomes available in stock again, store credit).

OUT OF STOCK ITEMS Occasionally you may see an item on display, but not be able to pay for it immediately or even add that item to the cart (basket). This means the item is sold out – please contact us by using the contact link next to the desired item, and we will let you know if and when this item will be available again.

OUT OF STOCK COLORS&SIZES Sometimes it may not be possible to choose certain colors or sizes from the drop down menu (even if you see these attributes displayed on a product image). This means some sizes or colors are out of stock. For example: you browse Body Piercing Jewelry and see 10 options of different crystals on the picture but you can only choose three colors from the drop down menu. That means only three item colors are available.

PRICES are subject to change without notice. „incl.VAT” means that shown price includes the Lithuanian VAT (21%) for EU customers. „excl.VAT“ means that the price shown is without the VAT

VAT Value Added Tax (incl.VAT).
Customers within the EU have to pay the VAT. As we currently ship from Lithuania, the VAT is 21%.

VAT FREE (excl.VAT) shopping (duty free) is possible for all customers outside EU (except CIS); for VAT registered business customers in EU (except Lithuania); for business customers in CIS countries (e.g. Russia). Please contact us for more info.

CURRENCY Only payment in EUR (Euro – EU Member Countries currency) is available at the moment. However, customer can see prices in GBP (British/UK Pound), LTL (Lithuanian Litas), USD (United States Dollar), and several other currencies. You can choose the desired currency on the top left panel of the website. You will find more info about payment and currencies in our PAYMENT section.


UPDATES & NEWS We update our online store constantly. Please subscribe to our newsletter and Facebook page to receive updates and follow the news.

COMFORT Please note that some of our clothes, boots & accessories are not meant to be worn for long periods of time (e.g. more than 6-8 hours) – e.g. heavy earrings, some heavy New Rock or high heel boots, crazy lenses. Of course we have lots of casual items for daily wearing, but we had to warn you that it’s probably not the best idea to go to studies or work wearing crazy lenses and steel boned corset. :)

For special care instructions please read the description and additional info of the particular product or see the page dedicated to particular product group, read help & FAQ, or contact us. Note: if you take care of your purchase it will last longer.
CLOTHING CARE INSTRUCTIONS
There are care instructions on tags of most of the garments (except if the item was specially tailored and handmade by us).
Most of our clothing is sensitive to high temperatures and detergents, and some have to be dry clean only. In fact, we recommend dry cleaning instead of washing. If washed, we advise you to follow these instructions: hand wash or use special washing machine settings for fragile mode; wash in cold or 30 degrees Celsius (86 F) water; no additive, no tumble, use special washing detergent; always fasten Velcro or zippers before washing/cleaning; dry flat and do not put in the dryer.
Advice: air (out) your clothes after each use, alternatively, clean only the dirty spots instead of washing all garment ;).
Black color may fade with time, to renew your item, try dying it (ask for info at your local store or dry-cleaners salon)
